Abstract

Financial institutions and banks provide financing for consumers, leasing, factoring. They generally use the procedure of the agreement which includes a fiduciary guarantee for fiduciary security objects. In practice, financial institutions provide movable goods requested by consumers. Consequently the debtor surrenders to the creditor in a fiduciary manner. Implementation of the executorial title by PT. Mandiri Tunas Finance is not through a court decision or fiduciary guarantee certificate, but only based on a power of attorney and agreement made by the collector . The sale of fiduciary collateral objects carried out by PT. Mandiri Tunas Finance does not go through public auctions but through separate sales; and Underhanded sales are not based on the agreement of both parties, the agreement is only based on PT. Mandiri Tunas Finance so that it harms the consumer. Actions taken by PT. Mandiri Tunas Finance does not provide legal certainty to both parties. The act of execution was carried out solely to safeguard assets regardless of legal certainty of the rights of consumers / debtors contained in fiduciary security objects in the form of car vehicles. Legal constraints of not registering the agreement are that execution cannot be carried out, based on Article 3 of the Minister of Finance Regulation No. 130 / PMK.010 / 2012 stating that finance companies are prohibited from withdrawing fiduciary objects in the form of motorized vehicles if the Fiduciary Registration Office has not issued a guarantee certificate fiduciary and hand it over to the finance company. With these provisions, PT. Mandiri Tunas Finance cannot execute if it does not register fiduciary collateral objects because without the registration of fiduciary collateral objects the fiduciary guarantee certificate cannot be issued.

Abstract

The integration of the judicial sub-system in the stage of investigating narcotics crime carried out by the Directorate of Narcotics of the West Sumatra Regional Police in the implementation of various obstacles was still encountered. The West Sumatra Police Directorate of Drugs Efforts in Realizing an Integrated Criminal Justice System During the Narcotics Crime Investigation Stage is to coordinate with BNN on rehabilitation recommendations. After the investigation is deemed completed, the investigator submits the case file to the public prosecutor and takes the pre-prosecution stage. Relationship with the District Court with its decision to give permission for forced efforts by investigators. The success of the integrated criminal justice system is highly dependent on the cooperation and coordination of all components involved in the system. Fragmentary symptoms still appear to be in the operational motion of the criminal justice sub-system, especially at the investigation stage. Another obstacle is that the investigation institution is not yet independent. The coordination system that will be carried out with the public prosecutors is also not done well. Unification of the understanding of the results of the investigation is a matter that determines the results of the investigation.

Abstract

The crime of misuse of three kilogram LPG gas that occurred in the Sawahlunto district police jurisdiction, as in the police report LP/2/SPKT-A/2018/Res Swl, this crime includes the misuse of three kilogram LPG in the case of abuse in the field of supply and distribution . Although this matter has been regulated in the legislation namely Law No. 22 of 2001 concerning Oil and Gas, Minister of Energy and Mineral Resources Regulation No. 26 of 2009 concerning the Provision and Distribution of Liquefied Petroleum Gas, 3 Kilogram Republic of Indonesia Presidential Regulation Number 104 of 2007 concerning Provision, Distribution and Pricing of Liquefied Petroleum Gas 3 Kilograms. As for the unlawful act taking place in the Sawahlunto area, the law enforcement of the perpetrators of the abuse of the three kilogram LPG is handled by the Sawahlunto Regional Police Criminal Unit.

Abstract

Upaya Polres Kepulauan Mentawai dalam penanggulangan tindak pidana penangkapan ikan dengan menggunakan bahan peledak adalah berupa sosialisasi Atau penyuluhan yang dipusatkan kepada masyarakat di desa desa nelayan yang terindikasi melakukan aktifitas penangkapan ikan dengan menggunakan bahan peledak. Melakukan Patroli Rutin yang dilaksanakan kurang lebih 2 kali dalam sebulan dan pada hari hari penting. Kendala Polres Kepulauan Mentawai dalam upaya penanggulangan tindak pidana penangkapan ikan dengan menggunakan bahan peledak adalah faktor tidak tegasnya penerapan sanksi pidana terhadap pelaku tindak pidana penangkapan ikan dengan menggunakan bahan peledak sering kasus hanya diselesaikan dengan pembuatan surat perjanjian dikarenakan faktor penyebab masyarakat menangkap ikan dengan bahan peledak hanya karena tuntutan ekonomi. Kendala lain adalah Kurangnya kepedulian masyarakat akan lingkungannya terutama lingkungan laut, kurangnya pengetahuan masyarakat nelayan akan dampak penggunaan bahan peledak dalam melakukan penangkapan ikan.

Abstract

The value of justice is indeed abstract and can be a benchmark for the consideration of justice of each person is different. Depends on the value that bases its paradigm on justice itself. However, in practice there are still many violations and deviations from the purpose of the law itself, both intentional and unintentional. The role of law enforcement should be to carry out their duties in accordance with applicable provisions. The crime of murder in a forced defense, explaining an act of murder which is clear in the end has severe sanctions, both Indonesian criminal law. Therefore from the existence of compulsion or force impulse which is the reason for the eradication of criminal acts in bringing up a criminal act of murder, whether in the end was punished as a justification or forgiveness in Indonesian criminal law. Tindak pidana pembunuhan dalam pembelaan terpaksa, menjelaskan suatu tindak pidana pembunuhan yang sudah jelas pada akhirnya memiliki sanksi yang berat, baik itu hukum pidana Indonesia. Maka dari itu dengan adanya keterpaksaan atau dorongan daya paksa yang menjadi alasan penghapus tindak pidana dalam memunculkan suatu tindak pidana pembunuhan apakah pada akhirnya dihukumi menjadi suatu alasan pembenar ataukah pemaaf dalam hukum pidana Indonesia.

Abstract

Kota Pariaman has enacted Regional Regulation Number 10 of 2018 which stipulates a policy of criminalization for sexual deviant behavior by LGBT. Forms of Criminalization of Sexual Abuse Behavior in the Regional Regulation of Pariaman City Number 10 Year 2018 is against behavior that is prohibited from being based on moral background. To maintain public morality, in the criminalization of LGBT, the City of Pariaman government imposes sanctions in the form of administration, which is the cost of enforcing local regulations and in the form of penalties in the form of fines and confinement in the alternative criminal system. Comparison of arrangements in Pariaman City Regulation No. 10 of 2018 explained in detail about the understanding of transgender and LGBT. The Criminal Code Bill does not provide a more detailed explanation, it only provides a regulation on what is meant by "obscenity".

Abstract

In the development of Indonesian National Law, the existence of Islamic law is very important, in addition to being a material for the preparation of national law, Islamic law is also an inspiration and dynamic in the development of national law. Likewise in the health sector, where the existence of Islamic law is an integral part of national law in the rules that exist in the health sector law. Intended to see whether Islamic law becomes an integral part of the rules in the field of health. Then whether the existence of Islamic law in these rules is explored from Islamic law which develops normatively into positive law. Therefore, Islamic law in the form of fatwas has a strong influence on the legislative process in Indonesia. All of this is clearly seen in the rules of health, first revealed elements of Islamic law that exist in the rules of health, namely the health law from independence to existing laws and apply to this day. So that the health law found a value system in Islam related to health, such as forbidden abortion, the existence of strict rules.

Abstract

The role of the substitute clerk in the implementation of the judicial principle that is fast, simple and inexpensive, as referred to in Article 45 of the Regulation of the Supreme Court of the Republic of Indonesia No. 7 of 2015 concerning the Organization and Work Procedure of the Registrar and Secretariat of the Court. The role of the criminal justice bureaucracy in the courts is very important to realize substantial justice because the Criminal Procedure Code adheres to a service model in the administration of criminal justice. The Substitute Registrar in the implementation of fast, simple, low-cost judicial principles at the Padang Class IA District Court is very decisive in the trial process to produce a quality decision to fulfill a sense of justice for the parties involved. The principle of a simple, fast and low-cost judicial system is one of the principles in the justice system in Indonesia as regulated in Article 4 Paragraph (2) of Law No. 48 of 2009 concerning Judicial Authority which reads "The court helps justice seekers and tries to overcome all obstacles and obstacles to achieve justice. simple, fast, and low-cost justice can be achieved". The role of the substitute clerk in the implementation of fast, simple, low-cost judicial principles at the Padang Class IA District Court is in charge of preparing the trial before the trial, during the trial and or the trial is in progress and after the trial and post-trial, such as assisting the judge in the trial, recording the course of the trial. then put it in the minutes of the trial. The obstacles encountered by the substitute clerk in the implementation of the principle of justice are fast, simple, low cost at the Padang Class IA District Court, both internally and externally. Internal factors, namely: a) The large number of incoming cases, making it difficult to determine the day of the trial; b) The existence of one of the Panel of Judges who handles criminal cases who are sick, on leave or are carrying out other tasks outside the city, thus causing disruption of the trial agenda that has been previously determined. External factors, namely: a) The presence of witnesses who are not on time from the trial agenda that has been set; b) The condition of the defendant who is sick, which is confirmed by a doctor's statement; c) The Public Prosecutor cannot present witnesses for several trials; e) The defendant or victim is unable to present a witness, because the witness is domiciled outside the city of Padang.

Abstract

Perlindungan Hak Kekayaan Intelektual (HKI) adalah merupakan pengakuan atau imbalan yang diberikan oleh negara kepada seseorang atas hasil karya intelektualnya. Perlindungan atas merek pada dasarnya merupakan bagian dari perlindungan hukum terhadap persaingan curang adalah perbuatan melanggar hukum di bidang perdagangan. Untuk melindungi hak atas merek, maka pemelik merek harus mendaftarkan mereknya menurut peraturan yang berlaku, yaitu Undang-undang Nomor 20 Tahun 2016 tentang Merek dan Indikasi Geografis. Namun dalam prakteknya tidak seperti yang diharapkan karena pelaku Usaha Mikro, Kecil dan Menengah (UMKM) di Provinsi Sumatera Barat belum menyadari betapa pentingnya pendaftaran merek dagang atau jasa, dan yang didapat dari pendaftaran merek dagang tersebut. Hal ini dapat dilihat belum optimalnya pendaftaran merek untuk dimintakan perlindungannya oleh pelaku usaha melalui Kantor Dinas Koperasi dan UMKM Provinsi Sumatera Barat kepada Kantor Wilayah Kementerian Hukum dan HAM Sumatera Barat. Oleh karena itu perlu dilakukan penelitian tentang bagaimanakah perlindungan hukum pemilik merek terdaftar bagi UMKM di Sumatera Barat, dan apa kendala-kendala yang dihadapi UMKM sebagai pemilik merek terdaftar dalam memperoleh perlindungan hukum. Data yang digunakan adalah data sekunder dan data primer. Teknik pengumpulan data dengan studi lapangan melalui wawancara untuk data primer dan studi kepustakaan untuk data sekunder. Data yang diperoleh dianalisis secara kualitatif dan disajikan dalam bentuk deskriptif analitis,yaitu hanya menggambarkan pelaksanaan perlindungan hukum dan kendala yang dihadapi UMKM dalam perlindungan merek terdaftar di Sumatera Barat. Hasil penelitian dan pembahasan, maka dapat disimpulkan bahwa Perlindungan Hukum Merek Terdaftar Bagi UMKM di Sumatera Barat adalah hanya diberikan Negara kepada pemilik merek yang terdaftar dalam Daftar Umum Merek untuk jangka waktu tertentu menggunakan sendiri merek tersebut atau memberi izin kepada seseorang atau beberapa orang secara bersama-sama atau badan hukum untuk menggunakannya, agar merek tersebut tidak ditiru oleh orang lain, dan sebagai alat bukti otentik bila terjadi pelanggaran hak atas merek serta sebagai pengawasan bagi aparat penegak hukum. Sedangkan kendala yang dihadapi UMKM sebagai pemilik merek terdaftar dalam memperoleh perlindungan hukum adalah lamanya waktu penyelesaian sertifikat merek oleh Dirjen KI, biaya pendaftaran merek mahal/tinggi, dan jaringan SIMPAKI untuk pendaftaran merek sering terkendala serta kurangnya sosialisasi tentang manfaat pendaftaran merek bagi UMKM.

Abstract

Prostitusi online yang telah meresahkan banyak kalangan masyarakat, hal ini telah diatur oleh KUH Pidana, RUU KUH Pidana, UU No 11 Tahun 2008 tentang Informasi dan Transaksi Elektronik serta UU No. 44 Tahun 2008 tentang Pornografi secara lebih mendalam. Penelitian ini merupakan penelitian hukum dengan spesifikasi deskriptif analitis. Pendekatan yang digunakan adalah pendekatan Yuridis Normatif yang didukung pendekatan Yuridis Empiris. Data yang dipergunakan adalah data sekunder, data primer, dan data tersier yang dikumpulkan melalui studi kepustakaan dan lapangan berupa wawancara. Data yang terkumpul kemudian dianalisis secara kualitatif dan disajikan dalam bentuk deskriptif kualitatif.
